1. Auction

To be able to bid, a potential buyer must be of legal age and register in advance on our website by filling out the required information. By registering, the buyer declares that they know and accept our trading conditions.

Trade Solution considers that anyone requesting registration as a potential buyer acts on their own behalf in online auctions, or alternatively guarantees that they are duly authorized by a principal in writing for this purpose.

In the event that two buyers make a maximum bid of the same level, the first bid submitted to Trade Solution will be considered valid. The maximum bid also prevails over a normal direct bid of the same level, as it was submitted earlier.

All bids made by online bidders are considered final and binding purchase and sale contracts. This implies that the online buyer on Trade Sulution acknowledges that, having made a binding purchase, they do not benefit from the Right of Withdrawal from contracts provided for in the legislation governing distance contracts.
This is justified by the fact that, in the case of distance auction sales, without just cause, it harms the penultimate bidder who was unfairly eliminated and also the seller who will not receive payment for the lot within the established deadline. Moreover, since the seller is not a “professional seller”, they are not subject to the Laws of the Right of Withdrawal.

Thirty (30) days after the auction of a lot, if the buyer has not paid, the withdrawal is considered automatic. This allows Trade Solution – without any authorization from the defaulting buyer who has thus lost their rights to the purchase of the lot and any right to compensation or redress – to place it again in a subsequent auction.

2. User Accounts

If you create an account, you agree to:

• Provide accurate and current information
• Maintain the confidentiality of your login credentials
• Remain responsible for all activities under your account

We may suspend or terminate accounts for misuse or violation of these terms.

Trade Solution reserves the right to refuse registration to anyone who has not punctually fulfilled obligations such as payments and withdrawals of one or more items in previous auctions.

3. Payments & Billing

By making a purchase, you agree to:

• Provide valid payment and billing information
• Authorize charges to your payment method
• Understand that all fees are non-refundable unless stated otherwise

All online payments are processed securely by third-party providers such as Stripe or PayPal.

E buyer agrees to make the aforementioned payment and collect the item within 5 business days following the date of purchase. After this 5-business-day period, Trade Solution reserves the right to charge aditional penalty.

The seller agrees to pay Trade Solution a commission of 15.006% from final auction price (which includes VAT, in accordance with the special regime for the sale of goods at auction) immediately after payment for the lot by the buyer was made.

In case of failure to pay the commission fee, a penalty clause will be applied for breach of contract (€500.00 for bids up to €5000.00, € 1000.00 for those ranging from €5000.01 to €10000.00 and €2000.00 for those exceeding €10,001.00).

4. Ownership & Intellectual Property

Ownership of the goods is only transferred to the buyer after the total sale amount has been paid to the seller.

Until the transfer of ownership, the goods remain the property of the seller.

Sixty days after the auction of a lot paid for by the buyer and not collected, the title of possession of the item will be considered reversed for all legal purposes.

The client authorizes Trade Solution to make photo, publish and use it, in any form and at any time for commercial, cultural, academic or other purposes, related or not to the auction, the image and description of all goods acquired through it.

All content on site tradesolution.pt — including text, graphics, logos, and digital assets—is owned by or licensed to us. You may not copy, modify, distribute, or reproduce any content without written permission.

5. Acceptable Use

You agree not to engage in the following:

• Using our services for unlawful activities
• Attempting to breach or bypass security measures
• Uploading harmful, malicious, or illegal content
• Interfering with website functionality

6. Items

The goods are sold in their current state of preservation, and it is the responsibility of potential buyers to personally confirm, through prior examination of the item, the accuracy of the description on our website, especially regarding any restorations, omissions, or defects mentioned therein. In the case of mechanisms, if there are no “Verificado” label indications, this means that the mechanism has not been tested. In this case, Trade Solution is not responsible for its operational condition. If Trade Solution indicates that the mechanism works, it does not guarantee that it is working perfectly. In the latter case, Auction’s responsibility ceases at the moment the item is collected (the piece can be tested by the buyer until the moment of collection).

Only if it is advertised as “Verificado” does our agency assume responsibility for the quality and authenticity of the item.

The pictures or representations of the item on the website are intended solely for the identification of the item being sold.

7. Limitation of Liability

Trade Solution is only an intermediary platform between buyer and seller.

Trade Solution is not liable to the customer for goods that, due to an act attributable to the seller or a third party, become the subject of claims or demands from third parties and/or are seized, provisionally or definitively, by the competent authorities, regardless of the date on which the respective claim, demand or seizure was determined or effected, and the nature or amount of any losses, damages or harm that may arise for the customer as a result of this event, which must be claimed by the buyer directly from the seller or the third party responsible.

Trade Solution is not liable to the customer for goods that are prevented from leaving the country or subject to any other encumbrance, charge or restriction, particularly regarding possession, use, enjoyment or transferability, including, under legislation protecting cultural heritage, regardless of the date on which the respective classification, inventory or listing was made, and the nature or amount of any losses, damages or harm that may arise for the buyer from such impediment, which must be claimed by the buyer directly from the seller or third party causing the impediment.

To the maximum extent permitted by law, Trade Solution is not liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or profits, and any loss or damage, including theft and robbery, that may occur to the item.

Any loss or damage to an item before its collection within the first 5 business days only entitles the client to receive an amount equal to the amount paid up to that point for the item, without any right to compensation, indemnification, or interest.

8. Disclaimer of Warranties

All services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free service.

9. Indemnification and collection

The collection and transport of goods is the sole responsibility of the client, considering that any assistance provided by Trade Solution, its representatives, employees, or collaborators is provided as a courtesy, and no liability can arise from this. For lots composed of numerous items (coins, stamps, records, written artifacts, etc.), verification of the contents must be carried out at the time of collection. Trade Solution cannot be held responsible if the buyer subsequently indicates differences in quantity/quality of the contents after collection.

You agree to indemnify Trade Solution against any claims, damages, or losses resulting from your use of our services, violation of these terms, or infringement of third-party rights.

When the collection is not carried out by the bidder themselves, it is always preferable for the buyer to send prior written or telephone notice indicating the full name of the person who will carry out the collection of the lots. However, we will also consider that if the person who comes forward, claiming the lots and indicating the full name of the bidder and the lots being bid on, and will provide a notarized copy of the buyer’s permission this information will be sufficient to consider this person authorized to carry out the items.

10. Changes to Terms

We may update these Terms & Conditions at any time. Continued use of our website or services means you accept any updated terms.

11. Governing Law

These Terms are governed by the laws of Portugal.

For the resolution of any conflict between parties, mediation may be used first (Business Mediation Association). If the mediation procedure fails, the competent court will be the Lisbon District Court.
